The Mengo Chief Magistrates Court today issued an arrest warrant against Moses Tumwiine, one of the suspects in the Pastor Robert Kayanja case.
Tumwiine and eight others are accused of trespassing on Kayanja’s property.
The principal magistrate, Adams Byarugaba, said Tumwiine had absconded from court proceedings three times. He also summoned Tumwiine’s sureties for not taking the responsibility of reminding the accused to appear in court.
The state attorney, Jonathan Muwaganya, had asked the court to arrest Tumwiine and his sureties over his absence.
Humphrey Tumwesigye, the defence lawyer, confirmed that he had lost contact with Tumwiine. But he pleaded with court not to summon the sureties.
The law says a trial of any person shall not take place in absence of that person unless court makes a ruling [to the effect that that person is removed from court].
“There is no evidence that criminal summons were served to A3 [Tumwiine] for the state to say they have to arrest the sureties,” Tumwesigye said.
The case was adjourned to May 5, 2025.
